One of President Rodrigo Duterte’s supporter and a very good lawyer, Atty. Trixie Cruz-Angeles get on it straight with what’s going to happen to Senate Minority Franklin Drilon after Janet Napoles named him as recipient of millions of pesos campaign donations.
The alleged “pork barrel scam” mastermind, Napoles, revealed that Senator
Franklin Drilon received P5 million from her during the 2010 elections.
In her Facebook page, Atty. Trixie enumerated what might happen
next to Drilon after the much-awaited revelation from Napoles.
She mentioned on
her post that once Napoles was able to secure an affidavit, then the Department
of Justice (DOJ) can proceed with an investigation.
Thus, with enough
evidence, a criminal case for corruption can be filed against Drilon before the
Ombudsman.
Next, with an
affidavit, Napoles can also file a case with the Commission on Election (COMELEC)
for non-disclosure of campaign contribution, which is punishable with disqualification
from office.
Atty. Trixie added
that, an ethics complaint against Drilon may also be possible. Below is her
complete post through Luminous- by Trixie Cruz-Angeles:
So what happens next for Drilon?
Well first, if Napoles executes an affidavit, the DOJ can
initiate an investigation and if there is enough evidence can file the case
with the Ombudsman. This is a criminal case for corruption.
Second if Napoles executes an affidavit she can file a case with
the COMELEC for failure to declare the campaign contribution. The penalty for
this is perpetual disqualification from office.
The corruption case is bailable.
The interesting one is the penalty
of perpetual disqualification. This can be the basis for Drilon to lose a
qualification to remain in office.
Pwedeng matanggal pala talaga si
Drilon.
PS. May posible pang ethics case.
