Manila, Philippines – On Wednesday, the National Bureau of Investigation
has filed criminal charges against retired police Gen. Marcelo Gabo before the
Office of the Ombudsman.
Garbo was among the nine high-ranking PNP officials linked
by President Rodridgo Duterte to illegal drugs.
According to NBI Director Dante
Gierran, criminal complaints against Garbo includes falsification of public documents,
violation of Republic Act 6713 or the “Code of Conduct and Ethical Standards
for Public Officials and Employees”, RA 3019 or the “Anti-Graft and Corrupt
Practices Act”.
Also, violation against RA 1379 or
“forfeiture of properties” in favor of the Philippine government against Garbo
and his wife, atty. Rosalinda Garbo.
The complaints filed was after the
NBI completed its investigation, conducted from December last year to October
2017.
The bureau concluded that former
police officer and his wife amassed assets that are beyond their legitimate
income and for non-disclosure of assets like vehicles and shares of stocks in
his Statement of Assets, Liabilities and Net Worth (SALN).
“The NBI likewise recommended that
a corresponding request through the Mutual Legal Assistance Treaty be made with
the US government to determine if indeed (Rosalinda) or any member of the
family owns a real property in the US and for eventual forfeiture in favor of
the Philippine government in accordance with the law,” Gierran said
“Nung pinatawag namin si General
Garbo [last July], pumunta naman ang lawyer niya, (When we summoned General
Gardo last July, his lawyer came) we were expecting some explanation [on
undeclared assets] pero he did not offer an explanation so we based our
findings sa mga documents na na-gather namin (but he did not offer an
explanation so we based our findings on the documents that we have gathered),”
NBI Anti-Graft Division head Nathaniel Ramos told the reporters.
Ramos, on the other hand, clarified
that they were not able to determine yet if the undeclared wealth were from
illegal drug trade.
